The faculty and staff of Montana State University who are engaged as private consultants for private clients are required by the terms of the MSU Faculty Handbook to provide the following notice to clients:

The Montana Board of Regents authorize faculty of the Montana University System to engage in private consulting activities and/or professional practice. When a faculty member is engaged as a private consultant, he or she is not acting as an employee of the university. The university is not a party to the contract engaging the consultant and is not responsible for performance of the contract. The University assumes no liability regarding the activities of its employees who act as private consultants and is not responsible for damages to client's property utilized for test, observation or otherwise in connection with the consulting engagement nor for consequential damages suffered by the client.

Faculty members engaged in private consulting or professional practice may not assign, commit, contract away or otherwise affect University rights, including the rights to intellectual property, without the express written consent of the Office of the Vice President for Research, Creativity and Technology Transfer. Any attempt by faculty to assign, commit, contract away or otherwise affect University rights without the express written consent of the Office of the Vice President for Research, Creativity and Technology Transfer shall be null and void.
